Thai individuals and Thai-owned companies can access the United States tax payable in respect of income from sources within the United States. This shall be allowed as a credit against the Thai tax payable in respect of that income.
Withholding taxes are levied against ALL foreign entities in the USA by the IRS!
Under US domestic tax laws, a foreign person or company is subject to 10%-30% US tax on the gross amount of certain US-source incomes. All people or companies (‘withholding agents’) making US-source fixed, determinable, annual, or periodical (FDAP) payments to foreign persons generally must report and withhold 10%-30% of the gross US-source FDAP payments, such as dividends, interest, royalties, etc. Withholding agents are permitted to withhold at a lower rate if the beneficial owner properly certifies their eligibility for a lower rate either based on operation of the US tax code or based on a tax treaty. Information reporting of the US-source payments is always required even if no withholding applies.
The 1996 Tax Treaty between the USA and Thailand allows any Thai company or Thai individual with investments or income sources in the US to receive a tax credit and / or a potential refund of Thai taxes on that income. This can be claimed retroactively for up to three years, and in some instances, this can be a substantial amount of money, acquired effortlessly and in a short period of time.
While these credits and potential refunds of tax credits are backed up by a solid legal grounding. In the past no firm had been able to apply for these credits in a way that the Thai government found acceptable.
